Abuja Court Dismisses Case Due to Lack of Diligent Prosecution
The Federal High Court in Abuja has dismissed a N1 billion lawsuit filed against former President Muhammadu Buhari and ex-Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele, concerning the hardships caused by the 2023 Naira redesign policy.

Justice Inyang Ekwo ruled that the plaintiff, Abuja-based lawyer Uthman Isa Tochukwu, failed to diligently prosecute the case, citing persistent absence from court without legal representation or explanation.
Details of the Lawsuit
The suit, marked FHC/ABJ/CS/418/2023, accused Buhari, the Attorney General of the Federation, Emefiele, the CBN, and two commercial banks of violating the plaintiff’s fundamental rights during the currency redesign period.
Tochukwu, represented by his counsel Bala Dakum, claimed his rights to freedom of movement and personal dignity were breached. He alleged he could not access his funds in banks during the policy’s implementation in January and March 2023.
Plaintiff’s Demands
The plaintiff sought:
- N1 billion in damages for the alleged rights violation.
- A perpetual injunction preventing further withholding of old N200, N500, and N1000 notes.
- A public apology published in two major newspapers.
Court’s Decision
During Monday’s hearing, neither the plaintiff nor his lawyer appeared, prompting the defense counsel, Chikelue Amasiani, to request the case’s dismissal due to lack of prosecution.
Justice Ekwo agreed, striking out the suit but allowing the plaintiff to refile if he demonstrates seriousness in pursuing the case.
